Effective September 13, 2026. These terms govern your use of LabelingIQ, whether you are a subscribing company, an employee of one, or an independent participant.
These Terms of Service ("Terms") are an agreement between you and LabelingIQ ("LabelingIQ," "we," "us"), covering the crowdsourced data-labeling and consensus platform at labelingiq.com and everything reachable from it. By creating an account, signing in, or using the service, you agree to these Terms. If you do not agree, do not use the service.
If you accept these Terms on behalf of a company, you represent that you are authorized to bind that company, and "you" means that company. Where your employer has created your account, your employer's own policies also apply to your use of it, and these Terms do not override the employment relationship between you.
Our Privacy Policy describes how we handle information and forms part of these Terms.
Company accounts belong to a subscribing organization. A company administrator creates employee accounts, assigns roles, and controls what each person can reach. Sign-in uses a password, or your organization's LDAP directory or SAML single sign-on where configured.
Participant accounts belong to individuals with no employer on the platform, who take part in campaigns that companies crowdsource externally. Sign-in uses a linked social account, or an email and password.
These are deliberately separate accounts with separate sign-ins. The same person may hold both, and holding one confers nothing on the other: a social account linked to a participant profile cannot be used to sign in to a company account, and a participant account cannot be signed into through the employee password form.
You are responsible for keeping your sign-in credentials secure and for activity under your account. Tell us promptly if you believe your account has been accessed without your permission. Accounts are for a single person; do not share credentials.
New companies begin with a 7-day free trial. A payment method is collected at signup, and no charge is made until the trial ends. When the trial ends, the plan you selected begins billing at the interval shown at signup, and renews automatically for successive terms until cancelled.
Payments are processed by Stripe. If a charge fails, we may retry it and may suspend access to paid features until payment succeeds; your data is retained during any such suspension in accordance with the retention terms below. Fees are stated exclusive of taxes, which are your responsibility where applicable.
You may cancel at any time from the Billing page, and cancellation takes effect at the end of the current billing term. Except where required by law, fees already paid are not refundable, and we do not pro-rate partial terms. We may change plan pricing on notice to company administrators, effective from your next term.
Independent participants are not employees, workers, agents, or contractors of LabelingIQ. Participation is entirely voluntary, there is no schedule, no minimum commitment, and no obligation on either side to offer or accept any campaign. You are responsible for your own taxes on anything you earn.
How payment is determined. Each externally crowdsourced campaign is configured by the company running it with a total budget and a minimum and maximum payment per participant. What you are paid for a completed campaign falls within that range and depends on a quality score computed from your answers, including how much time they took. The range applicable to a campaign is shown to you before you take part. Where the minimum and maximum are equal, the payment is a fixed amount.
When payment is not due. No payment arises for campaigns you do not complete. Employees completing their own company's campaigns are not paid per campaign; they participate as part of their role and may instead earn quality points and incentives their employer chooses to offer. A company may also switch off cash payouts for its own employees taking part in other companies' campaigns, in which case no payment is due for those.
How you are paid. Payouts are made to the PayPal or Venmo account you link on your Profile. Keeping that account accurate and able to receive funds is your responsibility, and we are not liable for amounts sent to an identifier you supplied incorrectly. We may withhold or reverse payment where we reasonably determine that answers were fraudulent, automated, or submitted in bad faith.
Your answers. Work you submit through a campaign is provided to the company running it, and you grant that company and LabelingIQ a perpetual, worldwide, royalty-free licence to use it for the purposes described in the campaign, including training and evaluating AI systems. Do not submit anything you do not have the right to provide.
You agree not to:
Submit answers you know to be false, generated automatically, or entered without genuine consideration, or otherwise game the quality scoring or payment system; create more than one participant account, or accounts in someone else's name; upload content that is unlawful, infringing, malicious, or that you lack the rights to share; attempt to access another company's or person's data, or any part of the service you have not been granted; probe, scan, or interfere with the security or availability of the service; scrape or bulk-extract data other than through the API or MCP Server provided for that purpose; or use the service to build a competing product.
Companies using the service are responsible for the campaigns they create, for having the rights to any data they upload or connect, and for complying with employment and data protection law in respect of their own workforce and any participants they recruit.
We may suspend or terminate access for conduct that breaches these Terms, and we may remove content that does. Where circumstances allow, we will say why.
You keep your data. Campaign content, labels, responses, and the material a company uploads or connects remain that company's. We claim no ownership of it. You grant us the licence needed to host, process, and display it in order to operate the service for you, and to create backups.
We keep the software. LabelingIQ, including its interface, code, and the LabelingIQ name and logo, remains ours. These Terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is active, and nothing more.
Retention and export. While your account is active you can export your data through the REST API and MCP Server. After termination we retain account data for 30 days so it can be restored on request, then delete it on our normal deletion schedule, except where we are required to keep records longer. Participants can remove linked accounts from their Profile at any time, and data deletion requests received from a social platform are processed automatically.
We work to keep the service available and secure, and we publish live security check results on our Security Status page. But the service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, and we do not warrant any particular outcome from campaigns run on it — including the accuracy, completeness, or fitness of the labels, consensus results, or summaries it produces. Those reflect the judgements of the people who supplied them.
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.
We may modify, suspend, or discontinue parts of the service. Where a change materially reduces functionality you are paying for, we will give company administrators reasonable notice.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify company administrators directly. Continuing to use the service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the service and cancel your subscription.
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules, and the state and federal courts located there have exclusive jurisdiction. If any provision is held unenforceable, the rest remains in effect.
